Retail Terms of Sale

Custom-order terms, payments, production, delivery, cancellations, and returns.

Effective October 12, 2026

Terms of SaleLimited WarrantyPrivacy PolicyWebsite TermsDealer AgreementPatent

These Retail Terms of Sale govern direct consumer purchases from Titan AV Cabinet Designs LLC, doing business as Aegis AV Cabinets (“Aegis AV,” “we,” “us,” or “our”). They are intended to provide one controlling set of terms for custom cabinet orders, payments, production, changes, delivery, inspection, cancellations, and returns.

Effective date: October 12, 2026

1. Scope and acceptance

These Terms apply to retail purchases made directly from Aegis AV. Dealer, distributor, trade, showroom, and resale purchases are governed by the applicable Authorized Dealer Agreement and purchase documents.

A customer accepts these Terms by signing or electronically accepting a quotation, proposal, invoice, or change order that incorporates or links to them; checking an acceptance box during checkout; or submitting an initial payment after receiving access to them.

The accepted quotation, final configuration, invoice, approved change orders, product-specific agreement, and these Terms together constitute the agreement for the order. If an order-specific written agreement expressly conflicts with these Terms, the order-specific agreement controls for that issue.

2. Custom and made-to-order products

Aegis AV cabinets are made to order for the customer’s selected cabinet model, dimensions, finish, projector, screen, audio system, room, installation, and options. Options may include motorized mechanisms, glass or acrylic, speaker doors, soundbar or subwoofer integration, cooling, rack mounting, lighting, extension cabinetry, and other customer-selected features.

Because these products are manufactured for a specific order and may be difficult or impossible to resell at their original value, they are not returnable or refundable for buyer’s remorse, preference changes, installation scheduling problems, inaccurate customer-supplied information, or other circumstances unrelated to an Aegis AV error, a covered defect, freight damage, or a right that cannot legally be waived.

3. Quotations and order approval

A quotation is an estimate based on the information available when it is prepared and expires on the date stated in the quotation. Pricing, availability, freight, taxes, and lead-time estimates may be revised before the customer accepts the quotation and pays the required initial deposit.

The customer must review the cabinet model, dimensions, finish, hardware, screen, projector, speakers, subwoofer, electronics, accessories, delivery address, access conditions, and other listed specifications before approving the order. Payment of the initial deposit confirms the customer’s approval of the written specifications, subject to any timely written corrections accepted by Aegis AV.

4. Initial deposit and production queue

Unless the accepted quotation or invoice states otherwise, a 50% initial deposit is required to place an order into the production queue. The remaining balance is due as provided in Section 10.

The initial deposit reserves production capacity and authorizes Aegis AV to begin order administration, specification review, design and engineering preparation, procurement, scheduling, and manufacturing activities. An order is not funded or placed into the active production queue until the initial payment has been received in cleared funds.

5. Cancellation during the first 48 hours

The customer may request cancellation by emailing [email protected] within 48 consecutive hours after Aegis AV receives the initial deposit. The request is effective when received by Aegis AV.

For a cancellation accepted within this 48-hour period, Aegis AV will retain an order-cancellation fee equal to 15% of the total accepted order price and refund the remaining amount previously paid. The fee compensates Aegis AV for consultation, specification review, design and administrative work, payment expenses, scheduling, and reserved production capacity.

For example, on a $10,000 accepted order with a $5,000 deposit, the cancellation fee is $1,500 and the refund is $3,500. The refund will ordinarily be issued to the original payment method.

This 48-hour cancellation policy is an Aegis AV contractual benefit and is not a representation that every transaction carries a statutory cancellation period. Aegis AV will honor any additional rights that applicable law does not permit the parties to waive.

6. Cancellation after 48 hours

After the 48-hour cancellation period, the order is not automatically cancelable. If Aegis AV has begun cutting, machining, drilling, routing, fabricating, finishing, assembling, ordering custom or nonreturnable components, or otherwise committing order-specific labor or materials, the 50% initial deposit is nonrefundable to the extent permitted by law.

A cancellation request received after 48 hours but before order-specific production or procurement begins will be considered individually. If Aegis AV approves the cancellation, any refund may be reduced by the 15% cancellation fee and by reasonable documented costs already incurred, including design, engineering, payment-processing expenses, materials, vendor charges, special-order products, and committed labor.

Cancellation after production begins requires Aegis AV’s written approval. Nothing in this section limits a remedy the customer may have for an Aegis AV breach, a verified defect, a material difference from the approved written specifications, or a right that cannot legally be waived.

7. Customer-requested changes

Changes requested after order approval must be submitted in writing. Aegis AV may require an approved change order and additional cleared payment before performing the change.

Changes may increase the price and extend the estimated completion date. The customer is responsible for resulting design, engineering, labor, materials, vendor, remanufacturing, freight, storage, and scheduling costs when completed or committed work must be changed, discarded, reordered, or performed again.

Changes to projector models, screen models or sizes, speakers, soundbars, subwoofers, electronic components, room measurements, finishes, delivery conditions, or installation plans must be communicated promptly.

8. Customer-supplied information and equipment

The customer is responsible for supplying accurate and complete information, including room measurements, door and elevator clearances, delivery access, projector model, screen model and size, speaker and subwoofer models, component dimensions, electrical requirements, ventilation needs, wall conditions, and installation restrictions.

Aegis AV is not responsible for fitment, compatibility, performance, or access problems caused by inaccurate, incomplete, or subsequently changed information supplied by the customer, designer, contractor, dealer, or installer. The customer is responsible for reasonable costs caused by such information, including modification, replacement parts, remanufacturing, transportation, storage, redelivery, and additional labor.

9. Production and shipment estimates

Production times, completion dates, pickup dates, transit times, and delivery dates are good-faith estimates unless Aegis AV expressly guarantees a date in a written agreement signed by an authorized representative.

Schedules may be affected by material availability, vendor delays, custom-component lead times, freight conditions, equipment problems, weather, utility interruptions, staffing, customer changes, unusually complex work, and events outside Aegis AV’s reasonable control.

If Aegis AV cannot ship within a promised or legally applicable period, Aegis AV will provide the delay notice, revised estimate, consent opportunity, cancellation option, or refund required by applicable law.

The customer should not schedule installers, contractors, freight elevators, building access, travel, or other time-sensitive services until the order has been released, a tracking or PRO number has been issued, and the carrier or installer has confirmed the applicable appointment.

10. Completion notice and final payment

When the cabinet is substantially complete, Aegis AV will normally provide completion photographs, the applicable invoice, payment instructions or a payment link, and information reasonably necessary to finish the transaction.

Unless the accepted quotation or invoice states otherwise, the remaining 50% balance and all approved additional charges are due within three business days after the completion notice and payment request are sent.

Aegis AV may crate the cabinet or arrange transportation while awaiting payment, but no cabinet, screen, accessory, or associated equipment will be released until the full outstanding balance has been received in cleared funds. Initiating an ACH transfer, wire, check, card payment, or other payment does not require release before the funds are confirmed.

11. Payment methods, processing fees, and taxes

Available payment methods will be stated on the invoice or payment request. Unless Aegis AV agrees otherwise in writing, a 2.99% processing fee applies to credit-card payments. Aegis AV does not charge the customer an additional processing fee for an accepted ACH payment.

The customer is responsible for applicable sales, use, excise, and similar taxes. A tax-exempt purchaser must provide valid exemption documentation before payment and remains responsible for any tax, interest, or penalty resulting from invalid or incomplete documentation.

Aegis AV may correct clerical, mathematical, tax, freight, or payment-processing errors before final payment.

12. Payment default and delayed release

Failure to make final payment when due constitutes a customer default. Aegis AV may suspend work or release, hold or stop a shipment, redirect or return freight, store the order, cancel remaining performance, and exercise other remedies permitted by law.

The customer is responsible for reasonable charges caused by the default, including storage, detention, rehandling, inspection, re-crating, shipment interception, reconsignment, return freight, redelivery, reshipment, address correction, vendor cancellation, payment reversal, returned-payment, and collection expenses to the extent permitted by law.

If Aegis AV agrees to resume shipment after a payment default, all outstanding balances and resulting charges must be paid in cleared funds before release.

13. Screens, electronics, and third-party products

Projection screens, projectors, speakers, soundbars, subwoofers, electronics, fireplaces, mounts, actuators, cooling components, controls, lighting components, and other products may be manufactured or supplied by third parties.

Custom-sized screens and special-order products may be nonreturnable once ordered. Any approved return of a standard third-party product is subject to the manufacturer’s or distributor’s authorization, deadlines, condition requirements, restocking charges, and shipping costs.

Drop-shipped products may arrive separately from the cabinet. Unless the invoice states otherwise, Aegis AV may delay ordering or releasing third-party products until required payments are received in cleared funds.

14. Freight service and delivery access

The order includes only the freight and delivery services expressly stated in the accepted quotation or invoice. Residential service, limited-access service, liftgate service, threshold or inside delivery, white-glove service, unpacking, debris removal, assembly, installation, stair carries, elevator coordination, and timed delivery are not included unless stated in writing.

The customer must disclose delivery restrictions before freight is scheduled, including narrow roads, gated access, limited hours, loading restrictions, stairs, elevators, doorway limitations, construction conditions, and required certificates of insurance. Charges caused by undisclosed or changed conditions are the customer’s responsibility.

The customer or an authorized adult representative must be available to receive the shipment unless another arrangement is approved in writing.

15. Inspection and freight damage

Before signing the carrier’s delivery receipt, the receiving person should inspect all visible sides of the crate and note punctures, crushing, missing pieces, mishandling, or other visible damage directly on the delivery receipt. The receiving person should photograph the shipment and visible damage before unpacking.

The customer must retain the crate, packaging, and affected components; notify Aegis AV promptly; and cooperate with carrier inspection and claim requirements. Concealed damage must be reported as quickly as possible and within the carrier’s applicable claim deadline.

Failure to inspect, document, retain packaging, or report damage promptly may limit recovery from the carrier. Signing a delivery receipt without noting visible damage may also affect the freight claim.

16. Installation and site conditions

Installation is included only if expressly stated in the accepted quotation or invoice. Unless Aegis AV is the contracted installer, the customer is responsible for selecting and supervising qualified installers and for site preparation, electrical service, wall construction, mounting support, code compliance, equipment setup, calibration, network service, and coordination with other trades.

Aegis AV is not responsible for damage or performance problems caused by improper installation, site conditions, unauthorized modifications, incompatible equipment, electrical or network problems, or work performed by others.

17. Returns after delivery

Custom and made-to-order cabinets are final sale and cannot be returned for convenience after delivery.

This restriction does not eliminate rights concerning verified freight damage, a covered manufacturing defect, a cabinet that materially differs from the approved written specifications, an Aegis AV error, or a right that cannot legally be waived.

The customer must notify Aegis AV promptly and provide photographs, measurements, serial numbers, delivery documents, and other reasonably requested information. Aegis AV must be given a reasonable opportunity to inspect and, where appropriate, repair, replace, or otherwise correct a verified problem before the customer incurs unauthorized repair, replacement, installation, removal, or transportation expenses.

18. Limited warranty

Aegis AV-manufactured products are covered only by the Aegis AV Limited Warranty in effect on the order date. The Limited Warranty is nontransferable and applies only to the original purchaser.

Third-party products and components are covered by their original manufacturer’s warranty, if any. Aegis AV will reasonably assist the original purchaser with an eligible manufacturer claim but does not enlarge, replace, or guarantee a third party’s warranty obligations.

Warranty coverage does not replace the customer’s duty to inspect freight or timely report shipping damage.

19. Renderings, samples, and natural variation

Digital renderings, photographs, screen displays, finish samples, and illustrations are intended to communicate design and appearance but may vary from the delivered product because of lighting, screen calibration, photography, material batches, grain, texture, sheen, and normal manufacturing variation.

Wood, veneer, and similar materials naturally vary in grain and color. Reasonable natural variation, grain continuation or transition, and minor differences between digital representations and physical materials are not defects.

20. Limitation of remedies and damages

To the fullest extent permitted by law, Aegis AV’s responsibility for a verified product defect or order error is limited to the remedies provided in the applicable Limited Warranty or these Terms. Aegis AV is not responsible for indirect, incidental, special, exemplary, or consequential damages, including loss of use, lost profits, lost revenue, installer standby charges, travel, lodging, or damage caused by unauthorized repairs or modifications.

These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be limited.

21. Events outside reasonable control

Aegis AV is not liable for delay or failure caused by events outside its reasonable control, including natural disasters, severe weather, fire, flood, epidemic, governmental action, labor interruption, transportation disruption, supplier failure, material shortage, utility or telecommunications outage, cyberattack, or similar event.

Aegis AV will use commercially reasonable efforts to communicate material delays and resume performance when reasonably possible. This section does not eliminate any notice, consent, cancellation, or refund obligation imposed by applicable law.

22. Electronic records and communications

The customer agrees that electronic signatures, checkbox acceptances, emailed approvals, electronic invoices, payment confirmations, and electronically stored records may be used to document the transaction to the extent permitted by law.

The customer is responsible for maintaining an accurate email address and telephone number and for reviewing communications concerning approvals, payment, production, shipping, and delivery.

23. Governing law and venue

These Terms and each retail order are governed by the laws of the State of Texas, without regard to conflict-of-law principles. To the extent a dispute may be assigned to a particular court by agreement, exclusive venue lies in the state or federal courts having jurisdiction in Tom Green County, Texas.

Nothing in this section prevents either party from pursuing a remedy in a forum that applicable law does not permit the parties to waive.

24. Entire agreement, severability, and waiver

The accepted quotation, invoice, approved change orders, product-specific written agreement, applicable Limited Warranty, and these Terms constitute the agreement concerning the order and supersede prior statements about the same subject.

If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Aegis AV’s failure to enforce a provision on one occasion is not a waiver of that provision or the right to enforce it later.

25. Changes to these Terms

The version provided or made available when the customer accepts the order governs that order unless Aegis AV and the customer agree otherwise in writing. Later revisions apply only to later orders and do not retroactively alter an accepted order.
